Charles Grist per ship Sophia assigned to William Buchanan, charged with trespass, having been expressly ordered to desist from coming. Col. Dumaresq states - having frequently seen the prisoner about my establishment and finding him one day in the hut of the milkman, I cautioned him against it and warned him if I found him on the establishment that I should cause him to be taken before the magistrates; he had been cautioned to the same effect by his overseer; he nevertheless persisted in coming very frequently. Occasionally passing the greater part of the night about the place as I had been informed by the servants. On Wednesday the 3rd instant he was seen about the place and on that day my court house was robbed and the cover of a carriage taken therefrom. Henry Yam states - I am servant to Capt. Dumaresq and the prisoner has been in the habit of coming frequently to Col. Dumardqs dwelling house and that on Wednesday I saw the prisoner on the farm to the best of my belief. James Compton holding a T/L employed by Col Dumaresq stated I have frequently seen the prisoner on my master s establishment. I have myself frequently told him that he was not to come. The prisoner admits the fact of being on the premises but denies having ever stolen anything belonging to the establishment. The Bench find the prisoner guilty and sentence him to 25 lashes
